Do You Need a License to Sell Non-Alcoholic Beer in New York?
No. New York's statutory beer definition sets no alcohol floor, and the State Liquor Authority has adopted the federal 0.5% standard: a beverage under 0.5% ABV is not an alcoholic beverage under the ABC Law. A 0.0% beer, wine or spirits alternative sells in New York as a food, direct to consumers and to any retailer, with no liquor licence on either side.
What New York law says
The Alcoholic Beverage Control Law's definition of beer carries no minimum alcohol content. The State Liquor Authority's Advisory #2019-1 resolves the point by adopting the federal 0.5% ABV standard: items under 0.5% are not alcoholic beverages for the purposes of the ABC Law.
What that means for an out-of-state brand
An overseas brand ships a 0.0% product into New York in the FDA lane: food facility registration, a US agent, FSVP, Prior Notice and an FDA-format label, and nothing from the Liquor Authority. What it does not cover
The advisory speaks to the ABC Law. Federal law is unchanged by it: a malt-based non-alcoholic beer still sits under TTB for federal labelling and formula purposes at any ABV, and a dealcoholized wine from a base over 7% ABV can too. Those federal points are about the label and the producer, and they do not put a New York licence on the sale.
